GENERAL ACCESS CONDITIONS
  1. These Terms and Conditions (hereinafter “Terms and Conditions”) govern the use of the website RECIFE - DESMONTAGEM DE VEÍCULOS, LDA., accessible from the address https://www.recife.com.pt/ (hereinafter “ RECIFE website”).
  2. A RECIFE - DESMONTAGEM DE VEÍCULOS, LDA., headquartered at Rua do Regueiro, Lote 5, Zona Industrial de Sobreposta, 4715-553 Braga, with the unique registration number and identification of legal person 505 128 160 ( hereinafter, “RECIFE”) is the legitimate and exclusive owner of the RECIFE Site.
  3. The use of the RECIFE Site by users of the RECIFE Site (hereinafter, “User”) presupposes and implies knowledge and acceptance, by the User, of these Terms and Conditions.
  4. The User declares to have the necessary legal capacity that allows them to accept these Terms and Conditions.
  5. RECIFE reserves the right to amend these Terms and Conditions, freely and at any time.
  6. The User hereby consents to the collection and computer processing of their data by RECIFE, which are inserted into an appropriate database for the purpose of their collection.
  7. The data collected at the time of customer registration is intended exclusively for the processing of any order and respective invoice and will never be provided to third parties.
  8. RECIFE is responsible for processing the data, and the User undertakes to provide and keep personal data up to date and ensure that they are true.
  9. The personal data provided by the User is intended, namely, for the management of RECIFE's customers and services, as well as marketing actions for RECIFE's services, under the terms defined in the PRIVACY POLICY of the RECIFE website.
  10. Under Regulation (EU) 2016/679 of the European Parliament and of the Council (General Regulation on Data Protection) combined with Law 58/2019, of August 8, Users are guaranteed, at any time, the right of access, rectification, updating, limitation and erasure of your personal data, the right to withdraw your consent, without compromising the lawfulness of the treatment carried out, based on the previously given consent, the right to object to their use for commercial purposes by RECIFE, as well as the right to data portability (except for data that are indispensable for the provision of the service or for compliance with legal obligations to which the controller is subject), which you can do, upon written request, or other means and contacts made available by the entity responsible for the processing of personal data, RECIFE, headquartered at Rua do Regueiro, Lote 5, Zona Industrial de Sobreposta, 4715-553 Braga or at the address RECIFE data protection via the e-mail address: geral@recife.com.pt .
  11. Access to our services and products depends on the free, express and unconditional acceptance of these terms and conditions, and the privacy policy.

INTELLECTUAL PROPERTY

The full content of the RECIFE Site, including, namely, texts, graphics, images, sounds, logos, brands, domains and any other elements, is the property of RECIFE, which holds, namely, the copyright and industrial property rights over the same, with the exception of content provided by advertisers or commercial partners that are identified as such. Copyright protection of RECIFE contents extends to all reproductions or copies obtained from the contents of the RECIFE Site.

SALE CONDITIONS
  1. The present Conditions of Sale detailed below exclusively determine the contractual relations between any customer User of the site www.recife.com.pt.
  2. The User is fully aware that all articles/parts/products marketed by RECIFE are used parts, coming from accident cars, susceptible to reuse in other vehicles.
  3. The availability indicated in the articles may change due to a momentary stock outage, the customer being informed of these changes.
  4. Certain items for sale in stores (counter) may have prices different from those advertised and marketed by RECIFE online, and there may also be exclusive prices online.

PAYMENT METHODS

The User customer has the following payment methods available:

  • Multibanco References
  • Just go to the nearest Multibanco or via Homebanking, select the 'Payment for Purchases/Services' option, and enter the entity, reference and value.

    Payment must be made after placing the order. If this does not occur within 3 days after placing the order, RECIFE reserves the right to cancel the order.

    The fact that an ATM reference is generated does not mean that the item is reserved. The reservation of the article only takes place with payment.

ORDERS AND SHIPPING
  1. All orders are sent via CTT Expresso or via another carrier, depending on the destination, and the shipment is only carried out on working days, and weekends and holidays are not counted for the estimate of delivery.
  2. Orders are shipped on the same day when payment is made and confirmed by 1pm on the same day, except in exceptional cases.
  3. Under the terms of Decree-Law No. 7/2004 of January 7, RECIFE reserves the right to unilaterally cancel any orders whose final price is wrong or out of date or whenever there is an error in programming, as well as in the event that the contractual proposal arrives at its destination incorrectly and the error concerns an essential element of the contract. The customer will be notified of this fact before payment has been made. However, if payment has already been made, the User customer will be refunded in full.
  4. Orders will only be processed after the respective payment confirmation has been made and will be sent to the address requested at the time of the order, so it is not possible to guarantee the availability of the items until the start of the respective order processing.
  5. On shipments to countries outside the European Union and depending on the laws of each country, Customs may require payment of taxes, which will be borne by the customer.
  6. In the event that any order shipped by RECIFE, for whatever reason (absence, wrong address, etc.), has not been delivered to the customer, the customer must file a claim within 6 months of shipment, otherwise the order will be given as lost and the customer will not be entitled to any credit for the order.
  7. Any change to the order information, after its submission, must be communicated by email and provided that the order has not been shipped. If shipment has already taken place, additional costs may apply.
  8. Any delay verified in the shipment of the order, in view of the shipping dates presented, does not entitle the customer to any compensation.
  9. In the case of an order, for collection at the store, of an item found in another warehouse/branch of RECIFE, RECIFE has a period of 5 (five) days to make the item available at the collection store.
  10. In the event that the customer places the order and payment and subsequently withdraws from the order, and if the order has not yet been shipped, the customer will bear the charge, corresponding to administrative expenses, of € 2.00.

GUARANTEES
  1. All items are guaranteed. Engines and gearboxes are guaranteed for 90 days, while the remaining parts are guaranteed to work for up to 14 working days.
  2. In the event of failure or non-compliance with the item, within the aforementioned warranty period, the customer must inform RECIFE and proceed with the respective delivery, for evaluation.
  3. Depending on what appears to be possible, after analysis and evaluation of the article, RECIFE will repair, replace the article or terminate the purchase and sale contract and refund the amount paid.
  4. In any case, labor costs with assembly or disassembly or assignment of replacement vehicles are excluded from the guarantee.
  5. The following cases are specifically excluded from the guarantee:
    • a. Transport damage not reported within 24 hours of receiving the parts;
    • b. Damage or paint defects, since the parts are used and may show signs of use;
    • c. Mishandling, inappropriate use, negligence, overload, current instability, voltage surges, faulty installation or assembly, and other external causes that are not attributable to the manufacture and quality of the part;
    • d. Damage caused by breakage, blows or negligent care;
    • e. Normal wear and tear of the product, as long as it is within the expected levels;
    • f. All situations that are detected as fraud attempts;
    • g. Violation of trademarks and recordings;
    • h. Repair or installation of parts carried out by unqualified personnel.
  6. The engine warranty refers exclusively to the main part of the engine, comprising the cylinder head, block, crankcase and respective internal operating components. In the case of diesel engines, the guarantee also includes the injection pump and the turbo, in the case of an engine with supercharging.
  7. The validity of the engine warranty presupposes proof of replacement of the timing belt.
  8. RECIFE will not be responsible for guarantees and/or returns in cases where parts require installation and/or special adaptations. For example: parts that require coding, from the moment they are manipulated, they lose their warranty; If you open a ECU, you lose the warranty.
  9. The activation of the guarantee is carried out upon presentation of the purchase invoice.
  10. The formalization of the purchase by the customer implies the acceptance of all the conditions expressed herein.

LAW AND APPLICABLE JURISDICTION

For all matters not expressly regulated in these Terms and Conditions, Portuguese law will apply. In the event of a dispute regarding the validity, effectiveness, interpretation, integration, application or compliance with these Terms and Conditions, RECIFE and the User accept that it be submitted to the exclusive jurisdiction of the District Court of Braga, with express waiver of any other .

With regard to contractual obligations resulting from purchase and sale or service provision contracts, it should be noted that, under the terms of Law No. 144/2015, of September 8:

“In the event of a dispute, the consumer may resort to the Automotive Sector Arbitration Center, with its website at www.centroarbitragemsectorauto.pt and head office at Av. da República, n.º 44 - 3º Esq, 1050-194 Lisboa".
